Two Sandiganbayan divisions order Napoles’ return to Bagong Diwa

Two of the three Sandiganbayan divisions handling the plunder cases of alleged pork barrel scam mastermind Janet Lim-Napoles have ordered her detention at Camp Bagong Diwa in Taguig City.

The Sandiganbayan First and Third Divisions on Monday denied Napoles’s plea to be transferred instead to the National Bureau of Investigation custodial center in Manila over alleged threats to her life.

Although the Fifth Division has yet to resolve the motions before it, Sandiganbayan Executive Clerk of Court Ma. Teresa Pabulayan said the two commitment orders can be immediately enforced since they were already issued.

The Sandiganbayan has denied the plea of former Vice-President Jejomar Binay to modify the standard terms of his conditional arraignment for his upcoming pilgrimage in the Holy Land. 

In an eight-page resolution on Monday, the Third Division rejected Binay’s fear that accepting the standard conditions would make him lose his rights and legal remedies later on.  

As a precondition for permission to go to Israel from May 15 to 29, Binay would have to be conditionally arraigned on Wednesday afternoon under the usual terms imposed on defendants traveling abroad. 

The antigraft court usually requires conditional arraignment before granting travel authority to an accused who has yet to be formally arraigned. This serves as an assurance that he could be tried in absentia in case he fails to return to the country. 

Binay’s camp plans to file a motion to quash the charges if the Supreme Court grants his petition challenging the validity of the Ombudsman’s investigation, which was held when he was still a vice-president immune from suit. But, such a remedy has to be filed before regular arraignment.

Bill seeks powers for Duterte to appoint village chiefs

An administration ally has gotten the ball rolling on the proposal to delay the barangay and youth council elections and empower President Rodrigo Duterte to fill up the ensuing vacancies.

Surigao del Norte 2nd Dist. Rep. Robert Ace Barbers, the House’s dangerous drugs committee chair, has filed House Bill No. 5359, in order to “support the President’s call to eliminate drugs and corruption” among the leaders of the country’s smallest political unit.
The said bill seeks to deem terminated the incumbent barangay officials who are currently serving in a holdover capacity after the village elections set for October 2016 was delayed by a year through Republic Act No. 10923.
In their place, the proposed measure simply provides that “officers-in-charge shall be appointed by the President.” The bill did not specify any qualifications for the possible appointees.

Former Senator Juan Ponce Enrile’s P172.83-million plunder case may finally head to trial, after the Sandiganbayan denied his motion to quash the purportedly “vague” charge sheet. Meanwhile, the Sandiganbayan has denied former Vice-President Jejomar Binay’s bid for his graft and malversation cases to be tried in a different court division separate from those of his son, former Makati City Mayor Jejomar Erwin Binay, Jr.
